Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "You", or "Your") and DrukMates ("Company", "We", "Us", or "Our") governing your access to and use of the DrukMates mobile application and any related services (collectively, the "Service").

These Terms apply to all visitors, registered users, subscribers, and any other person who accesses or uses the Service. DrukMates is intended for Bhutanese community members and their families in Canada and Australia. Use of the Service is void where prohibited by applicable law.

You must be at least 16 years of age to use DrukMates. By using the Service, you represent and warrant that you meet this requirement. If We become aware that a user is under 16, We will terminate their account and remove their data from our systems.

2. User Accounts

Account Creation

To access most features of DrukMates you must register for an account. You may sign up using an email address and password, or via a supported third-party OAuth provider (Google or Facebook/Meta). By creating an account you agree to:

• Provide accurate, complete, and current information, including your real name, valid email address, and your actual location (country, province/state, city)
• Maintain and promptly update your account information to keep it accurate
• Create only one personal account — duplicate accounts are prohibited
• Not create an account on behalf of another person without their express permission

Account Security

You are solely responsible for safeguarding your login credentials and for all activity that occurs under your account. You agree to:

• Keep your password confidential and not share it with any third party
• Use a strong, unique password not used on other services
• Notify Us immediately at 1527639@hustlersbae.info if you suspect unauthorized access to your account
• Log out of shared devices after each session

DrukMates is not liable for any loss or damage arising from your failure to protect your account credentials.

Username Policy

Your username must not impersonate another person, infringe any trademark or intellectual property rights, be offensive, vulgar, or obscene, or mislead others about your identity or affiliation. We reserve the right to require you to change a username that violates these guidelines.

Location and Country Settings

DrukMates serves Bhutanese diaspora members in Canada and Australia. Your selected country determines the content feed, currency display (CAD or AUD), emergency contact numbers, and local community you are placed in. You must select the country where you actually reside. Misrepresenting your location is a violation of these Terms.

3. Community Guidelines

DrukMates exists to connect, support, and celebrate the Bhutanese diaspora. Our community thrives when every member feels safe, respected, and heard. By using the Service, you agree to uphold the following standards.

Respect and Dignity

Treat every member of the DrukMates community with respect, empathy, and cultural sensitivity. We are a diverse community spanning generations, regions, and backgrounds within the Bhutanese diaspora. Content or behaviour that demeans, stereotypes, or discriminates against any individual or group based on ethnicity, religion, gender, age, disability, sexual orientation, or any other characteristic is strictly prohibited and will be removed.

Authentic Community Participation

• Post genuine, honest content that adds value to the community
• Engage constructively in discussions even when you disagree
• Respect other members' privacy — do not share personal information about others without their consent
• Report content that appears to violate these guidelines using the in-app report feature

Content Standards

All content you post — including posts, listings, job postings, event descriptions, campaign information, and messages — must be:

• Accurate: factually correct and not misleading
• Lawful: compliant with Canadian and Australian law, as applicable
• Respectful: free from hate speech, harassment, or targeted abuse
• Appropriate: suitable for a general community audience that includes families and elders

Moderation and Enforcement

We reserve the right to review, moderate, remove, or restrict any content or account that We determine, in Our sole discretion, violates these guidelines. Actions may range from content removal to temporary suspension to permanent account termination, depending on the severity and frequency of violations. We aim to be fair and proportionate, but We are not obligated to provide advance warning before taking action on serious violations.

4. Subscriptions and Payments

Subscription Plans

DrukMates offers the following plans. Pricing is shown in the currency of your registered country:

Billing and Renewal

• Subscriptions are billed on a monthly basis and renew automatically at the end of each billing cycle
• To avoid being charged for the next period, you must cancel at least 24 hours before the renewal date
• Subscription management (upgrade, downgrade, cancel) is handled through your Apple App Store or Google Play account settings
• DrukMates does not directly process or store payment card information — payments are handled by Apple or Google
• All charges are non-refundable except as required by applicable law or at Our sole discretion

Currency and Taxes

Prices are displayed in Canadian Dollars (CAD) for users registered in Canada and Australian Dollars (AUD) for users registered in Australia. Applicable taxes (such as GST/HST in Canada or GST in Australia) may be added at checkout as required by law. The displayed price may exclude taxes; the final charge shown in the App Store or Google Play will include all applicable taxes.

Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice to existing subscribers before any price increase takes effect, via in-app notification and/or email. Your continued use of a paid subscription after the effective date constitutes acceptance of the new pricing.

Downgrades and Cancellations

If you downgrade from Pro to Plus or Free, marketplace selling access is revoked immediately. Existing listings may remain visible but cannot be edited or renewed. If you cancel entirely, your subscription remains active until the end of the current paid period, after which your account reverts to Free.

5. Marketplace and Transactions

DrukMates provides a peer-to-peer marketplace platform where community members can buy and sell goods and services. Marketplace selling requires an active Pro subscription.

• All listings must accurately represent the item or service offered, including condition, price, and location
• Prices in marketplace listings must be expressed in the seller's registered currency (CAD or AUD)
• DrukMates is a platform only — We are not a party to any transaction between buyers and sellers
• DrukMates does not guarantee the quality, safety, legality, or availability of any listed item or service
• You are solely responsible for completing transactions safely, resolving disputes with other users, and complying with applicable consumer protection law
• We may remove listings that violate these Terms, community standards, or applicable law without notice
• Prohibited marketplace items include but are not limited to: illegal goods, weapons, controlled substances, counterfeit items, stolen property, and adult content

Customer reviews are available on food-category listings to help the community make informed decisions. Reviews must be honest and based on genuine experiences. Fake or incentivized reviews are prohibited.

6. Food Delivery

DrukMates may offer in-app food delivery coordination features that allow sellers to arrange delivery of food and goods to buyers within the community. By using any delivery feature, both sellers and buyers agree to the following:

Seller Responsibilities

• Ensure all food items comply with applicable food safety regulations in your province/state and country (Canada: provincial public health legislation; Australia: Food Standards Australia New Zealand)
• Accurately represent food ingredients, allergens, and preparation methods in your listing
• Package items safely and hygienically for transport
• Honour confirmed orders and communicate promptly if fulfilment is not possible
• Comply with any applicable local business licensing or home-based food business permit requirements

Buyer Responsibilities

• Provide an accurate delivery address and be available to receive the delivery within the agreed window
• Communicate any dietary restrictions or allergies directly to the seller before placing an order
• Inspect delivered items upon receipt and raise any concerns with the seller promptly

Location Tracking

When a delivery is in progress, the DrukMates app may request access to your device's GPS location to display real-time delivery tracking. Location data is used solely for the active delivery session and is not retained beyond the session. You may deny location permission, but real-time tracking will not be available. Location tracking is governed by our Privacy Policy.

Limitation of Liability for Delivery

DrukMates provides the delivery coordination interface as a convenience feature only. We are not a food delivery company, logistics provider, or party to any delivery arrangement. We are not liable for:

• Food quality, safety, or illness resulting from delivered items
• Delays, failed deliveries, or damage to items in transit
• Disputes between buyers and sellers arising from delivery
• Any accident, injury, or loss occurring during a delivery

Sellers who operate food businesses are independent of DrukMates. Any complaints about food safety should also be reported to the relevant authority: Canada — your provincial health authority or the Canadian Food Inspection Agency (CFIA); Australia — your state food authority or Food Standards Australia New Zealand (FSANZ).

7. Donation Campaigns

DrukMates provides a platform for community members to create and contribute to donation campaigns. By creating or donating to a campaign you agree that:

• Campaign creators are solely responsible for the accuracy of all information, goals, and evidence provided
• A minimum of 2 pieces of supporting evidence (photo or video) is required before a campaign can be published
• All donor names and contribution amounts are displayed publicly — this is an intentional transparency feature of the platform, not a bug
• Campaign funds are collected and managed between community members; DrukMates does not hold or process campaign funds
• DrukMates does not guarantee that donated funds will be used as stated by campaign creators
• DrukMates is not responsible for fraudulent campaigns, though We will take prompt action when fraud is reported
• Donations may not be refundable depending on campaign circumstances; resolve refund requests directly with the campaign creator

8. Privacy

Your use of DrukMates is also governed by Our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how We collect, use, store, and share your personal information when you use the Service.

Key privacy points you should be aware of:

• Your profile name, username, province/state, and city are visible to other users in your country
• Posts, comments, and marketplace listings you publish are visible to other users in your country
• Donation campaign contributions (name and amount) are publicly displayed
• Direct messages are private between participants and are not shared with other users
• Location data (GPS) is only accessed during active delivery tracking sessions, with your permission
• You can delete your account at any time via Settings — this permanently removes all your data

We strongly encourage you to read the full Privacy Policy before using the Service.

9. Prohibited Content and Conduct

The following is strictly prohibited on DrukMates. Violations may result in content removal, account suspension, or permanent termination, and may be reported to law enforcement where required by law.

Prohibited Content

• Hate speech and discrimination: Content targeting individuals or groups based on ethnicity, religion, national origin, gender, age, disability, or sexual orientation
• Harassment and abuse: Threats, bullying, intimidation, doxxing, or sustained targeting of any community member
• Misinformation: Deliberately false or misleading content, including fake news, medical misinformation, or fabricated immigration guidance
• Adult content: Sexually explicit material of any kind
• Child exploitation: Any content that sexualises, exploits, or endangers minors — We will report all such content to law enforcement and the Canadian Centre for Child Protection or the Australian Centre to Counter Child Exploitation, as applicable
• Violence: Graphic violence, gore, or content that glorifies, promotes, or incites violence
• Illegal content: Content that promotes, facilitates, or constitutes illegal activity under Canadian or Australian law
• Fraudulent listings: False marketplace listings, fake job postings, or fabricated donation campaigns
• Spam: Unsolicited bulk messages, repeated identical posts, or automated bot activity
• Malware: Links to or files containing viruses, spyware, or any malicious code

Prohibited Conduct

• Impersonating any person, business, or organization, including DrukMates staff
• Creating multiple accounts to evade a ban or suspension
• Scraping, crawling, or using automated tools to extract data from the Service
• Attempting to reverse engineer, decompile, or otherwise access the source code of the Service
• Interfering with or disrupting the integrity or performance of the Service or its servers
• Using the Service to send unsolicited commercial communications or to harvest contact information
• Selling, renting, or otherwise transferring your account or subscription to another person
• Circumventing any content filtering, access controls, or subscription gating implemented by DrukMates

10. Intellectual Property

The Service and its original content, features, design, and functionality — including but not limited to the DrukMates name, logo, colour scheme, and software — are and will remain the exclusive property of DrukMates and its licensors, protected by copyright, trademark, and other laws of Canada, Australia, and applicable international law.

By posting content to DrukMates you grant Us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish, and display that content on and through the Service for the purpose of operating and improving the platform. You retain full ownership of your content and may delete it at any time. We will not sell your content to third parties.

If you believe that content on DrukMates infringes your copyright, please contact us at 1527639@hustlersbae.info with the details of the alleged infringement.

11. Termination

Termination by DrukMates

We may suspend or permanently terminate your account, with or without notice, for any reason, including but not limited to:

• Breach of any provision of these Terms
• Conduct that We determine, in Our sole discretion, is harmful to the community or the Service
• Provision of false information during registration
• Legal requirements or court orders
• Extended inactivity (accounts inactive for more than 24 consecutive months may be removed)

Upon suspension or termination, your right to access or use the Service ceases immediately. We are not liable for any loss resulting from termination of your account for cause.

Termination by You

You may stop using the Service at any time. To permanently delete your account and all associated data, go to Settings → Account → Delete Account within the app. Account deletion is irreversible — all your posts, messages, listings, and profile information will be permanently removed from our systems. Active paid subscriptions must be cancelled through the App Store or Google Play before deletion to stop future charges.

Effect of Termination

Sections 8 (Privacy), 10 (Intellectual Property), 12 (Limitation of Liability), 13 (Governing Law), and any other provisions that by their nature should survive, will survive termination of these Terms.

12. Limitation of Liability and Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

DrukMates does not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

To the fullest extent permitted by applicable law, DrukMates and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, goodwill, or profits — arising from:

• Your access to or inability to access the Service
• Any content posted by other users on the Service
• Transactions or interactions between users, including marketplace transactions and delivery arrangements
• Food quality, safety, or health outcomes from food purchased or received through the platform
• Unauthorized access to your account or personal data
• Errors, viruses, or other harmful material transmitted through the Service

Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

For users in Australia, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified.

Dispute Resolution

We encourage you to contact us first to resolve any dispute informally. If informal resolution fails, disputes shall be resolved through binding arbitration conducted in British Columbia, Canada, in accordance with the applicable arbitration rules in force at that time, unless prohibited by applicable law in your jurisdiction.

By using the Service, you agree to waive any right to participate in a class-action lawsuit against DrukMates to the extent permitted by law.

Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes at least 30 days in advance via in-app notification and/or email to your registered address. Non-material changes (such as clarifications or formatting corrections) may take effect immediately upon posting.

The "Last Updated" date at the top of this page reflects when the Terms were last revised. Your continued use of DrukMates after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
